Wild camping in Portugal: what article 50-A actually allows

Since August 2021 Portugal's road code lets a motorhome overnight for up to 48 hours in one municipality, outside protected areas and the coastal strip, as long as you sleep and do not camp. Here is the statute text, the fines, and where the line sits.

Wild camping in Portugal is banned, but sleeping in a parked motorhome is not: article 50-A of the Código da Estrada, the road code, allows pernoita for up to 48 hours in the same municipality, outside protected areas and the coastal strip, as long as the parked vehicle never becomes a camp. That wording comes from Lei n.º 66/2021 of 24 August 2021 and replaced a stricter version in force since January that year. Verified against the statute as published in the Diário da República on 23 August 2026.

What the article says

Article 50-A has two operative rules. First, overnighting and aparcamento in a motorhome or similar vehicle are prohibited in Natura 2000 sites, in áreas protegidas and in the zones covered by the Planos de Ordenamento da Orla Costeira, the coastal management plans, except in places expressly authorized for it. Second, everywhere else, and where the município has no regulation of its own, pernoita of a motorhome homologated by the IMT (the transport institute) is permitted for a maximum of 48 hours in the same municipality. Expressly authorized places have no overnight limit under the article.

The definitions carry the weight. Pernoita is a motorhome staying put with occupants between 22:00 and 07:00. Aparcamento is parking that occupies more space than the vehicle’s own perimeter. Article 48 of the same code, also rewritten in 2021, adds three prohibitions for motorhomes: no campismo or anything associated with it on the public road or in public space, no discharge of organic waste or water outside the disposal systems meant for it, and no occupation of public space beyond the vehicle’s perimeter.

What that means at the kerb

Park and sleep, nothing more. You cannot open an awning, put out chairs or hang washing, because each of those is occupation beyond the perimeter, and most of them are campismo. Empty the cassette only at a proper point. Move to another município after two nights, and check whether the one you are in has its own regulation, because a municipal rule displaces the 48-hour default. It is the sleeping versus camping split of the rest of Europe, written into statute.

The sign at the car park and the câmara municipal’s current rule beat this page. A motorhome pictogram with a time panel is the law for that spot: Lei n.º 66/2021 added exactly that sign (C15a and H14e) to the traffic signs regulation.

The fines

Article 50-A sets a coima of 60 to 300 euros for breaking the 48-hour rule, and 120 to 600 euros when the overnight stay or aparcamento is inside a Natura 2000 site, a protected area or a coastal plan zone. Under article 48, camping on the road, dumping waste or spreading beyond the perimeter costs 30 to 150 euros, and parking a motorhome in a Natura 2000 site, an área de paisagem protegida or a coastal plan zone outside an authorized parking place costs 60 to 300 euros. Why the 2021 change matters

Decreto-Lei n.º 102-B/2020, published on 9 December 2020 and in force 30 days later, first introduced article 50-A as a blanket ban: overnighting and aparcamento prohibited everywhere outside expressly authorized places, with the night starting at 21:00. Lei n.º 66/2021 narrowed the ban to protected and coastal areas, created the 48-hour allowance, moved the night to 22:00 and kept the fine bands. Protected areas and the Costa Vicentina

The Parque Natural do Sudoeste Alentejano e Costa Vicentina is a protected area, so article 50-A applies across it. ICNF, the nature conservation institute, adds in its 2021 guidance note that the park’s management plan (Resolução do Conselho de Ministros n.º 11-B/2011, article 8) prohibits campismo and caravanismo outside the places designated for them. The same note sets conditions for new motorhome service areas inside the park: none within 500 metres of the high-water line, none in the strictest protection zones, no camping inside them.

The legal alternative: the ASA

An Área de Serviço para Autocaravanas is the designated place the statute keeps pointing to. ICNF describes it as a signed area with a service station for waste water, chemical toilet emptying, drinking water and rubbish, allowing motorhome overnight stays of no more than 72 hours, with no camping inside. Campsites (parques de campismo) are the other option. Either way the operator’s posted rules apply.

Is wild camping legal in Portugal?

Camping is not. Can I sleep in my van on the Costa Vicentina?

Not outside a designated place. The whole Parque Natural do Sudoeste Alentejano e Costa Vicentina is a protected area, which puts it under the article 50-A ban, and the park's own management plan (RCM n.º 11-B/2011, article 8) prohibits campismo and caravanismo outside the places set aside for it, according to ICNF's 2021 guidance note. Use a campsite or an ASA, the service area for motorhomes.
